High court grants new hearing in murder case
The West Virginia Supreme Court says a former nurse convicted of murdering her husband will get a hearing in her bid for a new trial.
Court spokeswoman Jennifer Bundy says the justices voted unanimously to send Michelle Michael’s case to Monongalia County Senior Status Judge Robert Stone.
Stone will determine whether the 37-year-old should get a new trial.
Michael argues her lawyers did a poor job representing her in the trial that led to her 2007 conviction.
She was convicted of murder and arson in the 2005 death of her husband, James Michael. He was injected with a paralyzing surgical drug before the couple’s house was set on fire.
Michael is serving a life prison term, with parole possible after 20 years.
