Judge comments after suspect mistakenly freed from jail

CHARLESTON — A Kanawha County judge says she did not intend to issue an order that ultimately led to an inmate’s mistaken release from jail.

Circuit Court Judge Carrie Webster said in a written statement Sunday that she immediately issued a warrant to have Jeremy Carter rearrested after she learned of the mistake.

Carter was released Thursday from South Central Regional Jail. He had been held on an attempted kidnapping charge.

Webster says her order dismissed a separate motion for a psychiatric evaluation. She says her order did not direct the charge against Carter to be dropped, nor for him to be released from jail.

Carter’s status isn’t clear. Jail records show he was not in custody Sunday.
