Doctor charged with distributing painkillers

CLARKSBURG — A Harrison County doctor was arrested Thursday on federal charges of overprescribing painkillers to patients without any legitimate medical reason.

U.S. Attorney William J. Ihlenfeld II said that Dr. Edita Milan of Fairmont was treating more than twice as many patients as she was permitted to treat with narcotics at her practice in Bridgeport.

Milan was charged with conspiracy to distribute controlled substances. She voluntarily surrendered her Drug Enforcement Administration registration number, meaning she can no longer prescribe controlled substances.

Milan’s office was closed and there was no telephone listing for her in the Fairmont area.

Investigators initially had focused on an employee of Milan’s who was selling painkillers to an undercover officer in the practice’s parking lot. A Harrison County pharmacist provided information that shifted the investigation to Milan, Ihlenfeld said in a news release.

The criminal complaint alleged Milan tried to conceal her connection to a patient who died of an overdose. Agents reviewed state health records and found that three other patients died as a result of overdoses between 2010 and 2011.

“As this case demonstrates, federal, state and local law enforcement continue to stand united to tackle the drug problem in North Central West Virginia and throughout the state,” Ihlenfeld said in the release. “Together, we are making a positive difference as we aggressively pursue doctors who seek to hide behind a medical license in order to traffic in highly addictive and sometimes deadly substances.”

Agents seized hundreds of patient files from Milan’s office in June during a search. Patients who want copies of their files can submit a request in writing to the U.S. Attorney’s Office at P.O. Box 591, Wheeling, WV 26003.
