CHARLESTON —
Three Logan County residents have abandoned their federal lawsuit alleging sexual assault, excessive force and other illegal actions by sheriff’s deputies.
U.S. District Judge John Copenhaver dismissed the case in a Tuesday order, citing the plaintiffs’ failure to pursue it.
The woman and two men who filed suit last year were not identified in it. Nor were the three deputies whom they allege accosted them outside a Logan club in September 2008.
The lawsuit alleged that the two men were threatened while the woman was driven down a dirt road and raped.
Copenhaver in January allowed the plaintiffs’ lawyers to withdraw from the case. The lawyers had reported multiple unsuccessful attempts to communicate with their clients about the case.
