Two felony cases waived, headed to the grand jury

Two felony cases before Wyoming County Magistrate J.R. Boles were waived to the grand jury Thursday.

Timothy Edward Lane, 36,  of Brenton, was charged with felony nighttime burglary following his arrest by Wyoming County Deputy Sheriff Matt Shifflette. Lane, with counsel R. Keith Flinchum of Princeton, waived his right to a preliminary hearing. His case is likely to be presented to the October term of the grand jury. Lane remains incarcerated pending the resolution of his case.

Johnny Joe Marcum, 55, of Mullens is charged with one count of possession of a controlled substance with the intent to deliver.

Marcum also waived his right to a preliminary hearing and his case will proceed to the grand jury.

Marcum is currently incarcerated following the issuance of another warrant charging him with a crime alleged to have occurred on the day he was released on bond in the drug case.  

Prosecutor Michael Cochrane said the state intends to file a motion to revoke his bond on the felony charge following his arrest on assault.

Mullens City Police Chief Ray Toler and Assistant Chief Jack Meadows are handling the Marcum investigation. He is represented by W. Randolph McGraw II of Beckley.  

Cochrane said, "I believe that drug crimes and crimes involving the breaking and entering of someone's home to be some of the most serious matters my office handles. It is important that those who have crime in their hearts realize that we will not allow them to sell drugs or invade the homes of the good people of Wyoming County.”
