Three defendants sentenced by Hutchison in circuit court

Three defendants appeared for sentencing before Judge John Hutchison in Raleigh County Circuit Court Wednesday.

Shawn Owen Gillespie II, 20, of Crab Orchard, received five years’ probation with underlying suspended consecutive sentences of one to 10 years for grand larceny and one to five years for conspiracy to commit a felony.

Hutchison also ordered Gillespie to reside with his grandparents and abide by the “lawful directives” of his grandparents and mother.

Also, he must enroll in Raleigh County day report, complete an 80-hour miner certification course and seek active employment.

David Mitchell Kincaid, 23, of Beckley, was ordered to serve 90 days for driving revoked due to DUI as well as a 90-day alternative sentence with an underlying sentence of one to 10 years for entering without breaking.

Kincaid was given credit for time served, meaning he has already completed one 90-day term and has served 65 days on the second.

Additionally, Hutchison ordered Kincaid to complete the LEARN program at FMRS.

Upon release from jail, Gillespie must complete three years’ probation.

Curtis Richards, 26, of Parkersburg, was sentenced to one to 10 years for uttering.

That sentence will run consecutively to a sentence he is currently serving for a Kanawha County conviction.

Richards was also ordered to pay $2,329 in restitution.
