A Virginia man was charged with felony DUI last Friday after being charged with his fourth DUI in West Virginia and police reports indicated the man also had two additional DUI charges in Virginia.
Robert Preston Montgomery, 32, of Covington, was driving in White Sulphur Springs about 11 p.m. and stopped at a convenience store when officer E.W. Sullivan observed him staggering while exiting his vehicle, according to the criminal complaint.
After Sullivan smelled alcohol on his breath, Montgomery failed a preliminary breath test. He later refused to take further blood/alcohol tests. When Sullivan checked his drivers history in Virginia, it revealed “that he had been charged by Alleghany County for DUI” in July and June of 2000. A West Virginia drivers history proved that Montgomery “had three DUI’s, two in 1997 and one in 1996,” according to the complaint.
Montgomery was taken to Southern Regional Jail and was released the next day after posting a $6,000 bond. Montgomery was also charged with the misdemeanor offense of driving while his license was revoked for DUI.
