3 plead guilty in Wyoming County

Three people entered guilty pleas Monday in Wyoming County Circuit Court.

Kelly Steven Conn, 37, of Simon, pleaded guilty to delivery of a controlled substance and attempt to commit a felony, burglary.  

Conn was sentenced to one to five years for delivery and one to three years for attempt to commit a felony, to be served concurrently (at the same time).

Wyoming County Prosecuting Attorney Micheal Coch-rane said these felony convictions provide justice as well as serve a warning that these criminal activities must stop.

“Any future crimes expose him to the very real possibility of a life sentence,” Coch-rane said. “My office’s goal has been to use the tools provided by the West Virginia Code to protect the citizens of Wyoming County by punishing those people who create the biggest threat to their safety. I believe this agreement is a step in the right direction.”

Samantha Stout, 21, of Huntington, pleaded guilty to two counts of acquisition of a controlled substance by misrepresentation, and one count of daytime burglary.

Special Judge Charles Vickers sentenced Stout to one to 14 years total: two terms of one to four years for acquisition, which will run concurrently, and one to 10 years for daytime burglary, which will run consecutively to the other sentences.

Stout was also ordered to pay restitution and agreed to waive any motion for alternative sentencing.

“Those people who steal the property of others should not believe that they will escape jail because their crime caused no physical harm to another,” Cochrane said. “The harm caused by thieves is substantial, and an overwhelming portion of those involved in property crimes do so to fuel the drug dealers.”

Ricky Dale Mitchell, 55, of Davin, pleaded guilty to wanton endangerment after firing a rifle during an argument with his wife, which led to his arrest.

Mitchell has requested a pre-sentence investigation prior to his sentencing, which has been scheduled for May 19.
