Rhodell man bound for prison after judge revokes probation

By Michelle James
Register-Herald reporter

A Rhodell man was sent to prison Friday when Raleigh County Circuit Judge John Hutchison revoked his probation.

Hutchison reinstated 31-year-old Timothy William Cadle’s sentence of one to 15 years for delivery of a controlled substance after he admitted to violating his probation by using drugs.

Public defender Gary Frasher asked Hutchison to allow Cadle, who fell asleep during the hearing, to attend rehab for his drug problem, telling the judge his client was staying on top of the problem while required to stay in the homeless shelter just following his sentencing.

It was when he was allowed to return to his home in Rhodell that he ran into problems again.

Frasher suggested Cadle return to jail to await placement at a long-term treatment facility.

Hutchison, however, expressed his displeasure with the situation, telling Frasher his client had plenty of time to seek assistance on his own.

“It’s a problem I see every time,” he said. “(Defendants) telling me they’ve got this giant addiction demon hanging over their head, (but they don’t do anything to get help) until they’re looking at me slamming the door in their face ...

“If I’ve got to make them take rehab, there’s no chance they will successfully complete it.”
