Plea given; probation revoked

Michelle James
Register-Herald Reporter

A 31-year-old Oceana man was sentenced to prison Tuesday morning after entering a guilty plea before Raleigh County Circuit Court Judge John Hutchison.

James O. Adkins was sentenced to one to five years for conspiracy to commit a felony.

The sentence will run concurrently with a two- to 25-year sentence he is serving for a parole revocation.

Brandy Musick, 24, of Bolt, was ordered to home confinement when she appeared before Hutchison for a probation status hearing Tuesday.

Chief deputy prosecutor Kristen Keller told Hutchison that Musick, who, on Aug. 21, 2007, was sentenced to three years probation with an underlying one- to five-year sentence for conspiracy, had failed to follow an order that she stay at her mother’s house in Bolt.

Musick’s attorney Karen Kostol explained that because of transportation issues, her client had to stay with her boyfriend in Beckley in order to attend the Raleigh Day Report Center. Also, Kostol said, Musick, has had good reports from the center.

Hutchison told Musick, who appeared before him in March for another probation-related issue, that she must stay at her mother’s home and if she had any future problems, she would be sent to jail.

Carson O’Bryan, 37, of Beckley, was sentenced to one to five years when Hutchison revoked his probation Monday.

O’Bryan’s probation was revoked as a result of a guilty to conspiracy plea he entered before Judge Robert Burnside July 16.

The sentence will run concurrently with the one- to five-year sentence issued by Burnside.
