Carjacking murder suspect waives preliminary hearing

BECKLEY — Public defender Eric Shuck waived a state deadline Tuesday for the preliminary hearing of a man accused of murdering a 77-year-old man.

Mickey Roger Daniel Jr., 29, of Edwight, allegedly shot Johnny Nile Condia on Oct. 11 while Condia was inside his vehicle on Saxon Bolt Road in Arnett.

According to police, Daniel took Condia’s 2005 Toyota Corolla, leaving Condia lying in the roadway.

Condia was transported to Raleigh General Hospital where he died from his injuries.

Raleigh County Prosecuting Attorney’s Office Special Investigator Jeff Shumate said the state code requires that jailed suspects receive a preliminary hearing within 10 days of their arrest.

Shumate said Shuck opted to waive this time period in order to further his investigation. This will also allow the state to continue processing physical evidence and talk to witnesses.

Shumate said the hearing will be reset, but there is no time limit for the rescheduled hearing.

Daniel will remain in custody at Southern Regional Jail without bond.
