Wyoming indictments released

PINEVILLE — Two Wyoming County murder cases will move forward, following indictments by the most recent grand jury, according to Prosecuting Attorney Micheal Cochrane.

John Douglas New, 20, of Coal Mountain, was indicted on first degree murder, sexual assault in the first degree, daytime burglary and grand larceny. He is accused of killing Francis Elaine Birchfield, 60, who lived alone on Shannon/ Mill Creek Road in Brenton, on Feb. 12, then stealing her truck.

At the time of the murder, authorities said they believe Birchfield was killed when she interrupted a robbery in her home.

Wyoming County Sheriff Randall Aliff said New was arrested by the Gilbert Police Department, in Mingo County, when he was spotted driving Birchfield’s truck a few hours later, Aliff said.

They stopped the truck and arrested the suspect, the sheriff noted.

Joshua Dale May, 30, of Saulsville, was indicted on first degree murder in connection with the April 29 stabbing death of his 63-year-old mother, Sandra May, in the front yard of the home where both lived, according to officials.

Wyoming County Sheriff’s Chief Deputy C.S. Parker said May and his mother apparently got into an argument. She left the house and went into the yard, Parker said. May followed her and allegedly stabbed her with a knife, Parker said. May lived with his mother on Bower’s Ridge Road.

Deputies arrested May at the scene about 12 minutes after the 9:18 a.m. call came into the county Emergency Center, according to Aliff. May was locked inside the residence, Aliff said.

“Officers made a forced entry and arrested him without incident,” according to the sheriff.

Medwin Jorrell Willard, of Brenton, was indicted for malicious assault, kidnapping, malicious assault of the elderly and grand larceny in connection with an attack on his grandparents, according to officials.

Danny Justus, Brenton; malicious assault; brandishing.

Van Buren Mullins, Lynco; sexual abuse by parent, guardian or custodian; sexual assault third degree.

Paul David Sartin, Glen Fork; sexual assault second degree; incest.

Rebecca Dawn Duty, Pineville; forgery/uttering.

Justin Allen Morgan, Oceana; destruction of property.

James Wesley Seaton, Mullens; forgery/uttering.

Jason Dean Goodwin, Oceana; breaking and entering; grand larceny; destruction of property.

Mildred Taylor, Ikes Fork; possession of a controlled substance; contributing to the delinquency of a minor.

Gary Lewis Vance, Verdunville, breaking and entering, felony destruction of property, grand larceny, and misdemeanor conspiracy.

Ladonna Sue Tomblin, Verdunville; aiding and abetting breaking and entering.

Tina Marie Miller, Lynco; forgery.

Alicia Tilley, McGraws; burglary; battery.

William Michael Short, Beckley; operating a clandestine drug laboratory.

Robert Ronald Moore, New York; delivery of controlled substance; possession of a controlled substance; transporting a controlled substance into the state.

Crystal Dawn Gibson, Man; delivery of a controlled substance.

James Wesley Seaton, Mullens; forgery/uttering.

Rebecca Dawn Duty, Pineville; uttering.

Jason Dean Goodwin, Oceana; breaking and entering; grand larceny; entering without breaking; petit larceny.

James Robert Cook II, Princeton; third offense shoplifting.

Based on state code, the fact that a defendant has been charged with a crime is merely an accusation; the offender is presumed innocent until proven guilty beyond a reasonable doubt, Cochrane emphasized.
