Stoney Glen designation rescinded

LEWISBURG — The Stoney Glen development is no longer officially a subdivision. Wednesday evening, the Greenbrier County Planning Commission unanimously rescinded the designation.

The subdivision was not listed on the agenda handed out at the meeting. A commission staffer later said he understood the issue had been discussed at an earlier meeting and tabled, removing the need for it to appear on a subsequent agenda.

In calling for the rescission, commission president Bill Snyder cited “substantial breaches” of an agreement made among Stoney Glen owner, West Virginia Farm Properties LLC, and the planning agency.

The agreement touches upon the developer’s financing arrangement with World Equity and requires the lender to provide the planners with written confirmation of three points:

Acknowledgment of planning commission authority.

Agreement to notify the planning commission of any default by West Virginia Farm Properties.

Verification by the lender of the amount of the loan which was designated for water and sewer construction.

According to Snyder, the developer’s failure to provide the confirmation stipulated in the agreement constitutes a breach.

The last item in the agreement provides, “West Virginia Farm Properties agrees that should it not comply with the above conditions, then the approval of the plat shall be rescinded by the Planning Commission.”

The document was signed July 23, 2007, by William L. Sharp, managing member of the development company.



In a working session held just prior to the planners’ regular monthly meeting, much of the discussion focused on the updated comprehensive plan. Because some of the newly appointed commission members were unfamiliar with the document, in the works for the past year, the planners decided to postpone advancing it to the public hearing stage.

The hearing will be held Aug. 26. Until that time, the public may review the proposed plan online via a link at www.greenbriercounty.net or look through a paper copy in the planning commission office. Eventually, a paper copy will also be made available in each of the county’s public libraries.

The planning commission will not meet in July.
