Lewisburg couple sues county clerk for property claim

LEWISBURG — A Lewisburg couple has filed a civil suit against the Greenbrier County clerk, claiming he incorrectly allowed a woman to claim she was an heir to property the couple had bought at a sheriff’s tax auction last year.

Donald L. Steele and Judy K. Steele named County Clerk B.J. Livesay and Cheryl-Ann Marie Burns Waldron as defendants in the suit, filed by Lewisburg lawyer Barry Bruce.

The suit states the Steeles purchased three parcels of property for $2,900 in November 2007 that were for sale because of non-payment of taxes. In December 2007, the Steeles were refunded their $2,900 by Livesay and was informed that “the property had been redeemed by an heir named Cheryl-Ann Marie Burns Waldron.”

The Steeles claim Burns should not have been allowed to redeem the property because she was not a legal heir.

“... Burns fraudulently represented to Livesay when she redeemed the property that she was an heir ...,” the suit said.

The Steeles are claiming Livesay should have obtained proof from Waldron that she was a rightful heir prior to allowing her to redeem the property.

The Steeles are requesting that the three lots be returned to them for the original amounts paid.
